Terms and conditions

This Agreement applies to your PayFree eWallet account and affects your rights; please read it carefully. By checking the Agree to the Terms and Conditions on the Sign Up page, you agree that you understand and and you agree to abide by all terms, conditions, and rules set forth herein.

The PAYFREE e-Wallet site is provided as a service to PAYFREE members. The site is to be used only for the services that it offers within the user login section and no exceptions or alterations can or will occur. PAYFREE reserves the right to update, modify, improve or discontinue services as the need may arise.

“We”, “our” or "us” refers to Web eWallet, its subsidiaries, its affiliates, and its officers, directors, employees and agents. “You” and “Your” refers to the user of this web site.

Applicable Philippine Laws shall govern this agreement. In the event of any conflict between the provisions of this Agreement and any applicable law or regulation, this Agreement shall be deemed modified to the extent necessary to comply with such law or regulation. This Agreement shall be governed by, and construed in accordance with the laws of the Republic of the Philippines and any proceeding or actions with respect to this Agreement or any services hereunder shall be brought only before a legal court in the Republic of the Philippines.

To the extent permitted by law, by the use of this e-wallet or permitting the use of the debit/cash card you agree that you will not bring, join or participate in any class actions to any claim, dispute or controversy you may have against us or our agents, servicers, director, officers, members and employees. You agree to pay the cost we incur, including our court costs and attorney’s fees, in seeking such relief. This agreement is not a waiver of any of your rights and remedies to pursue a claim individually or not as a class action in binding arbitration as provided above. This is an independent agreement and shall survive the closing of your account(s).

Any misuse or attempted misuse of the services being provided within www.PayFree.com.ph site will cause immediate suspension or exclusion of the offending member. Any attempts at fraudulent or misleading essential information will also cause immediate termination of services to the member. You must be aware of your local laws and regulations that govern the use of the services www.PayFree.com.ph provides. Any activity that may be deemed as money laundering or fraudulent transactions (by any means including identity theft, false documentation, etc) will be reported to the appropriate authorities. Using the site for its intended purpose - to allow simple, convenient methods of transferring your funds or pay for goods - will assure the continued service it provides.

Anti-Money Laundering Policy ensures that the highest standards of due diligence are applied to the "know your customer" principles; that every staff member consistently complies with legislation requirements and appropriate guidelines in the jurisdictions in which we operate, and at all times we ensure the protection of our members, merchants and staff, and safeguard the PAYFREE e-Wallet brand and reputation. We place responsibility within each jurisdiction for ensuring compliance with the jurisdiction's legislation and procedures for combating money laundering to the relevant Money Laundering Reporting Officer.

REGISTRATION INFORMATION

You agree to provide us with true, accurate and complete registration information, and to maintain and promptly update your information provided to us. If any information you provide is untrue, inaccurate, not current, or incomplete, PayFree has the right to immediately terminate your use of our Service without prior notice and we have the right to recover from you any costs or losses incurred as a direct or indirect result of the inaccurate or incomplete information. You hereby authorize us and our agents, suppliers, and subcontractors to make any inquiries with any third party we and they consider necessary to validate your registration with us. This may include verifying the information you provide against third party databases.

COMMUNICATIONS RISK

In the event of the loss or malfunction of any communications device used by yourself or any entity relaying information between you and us, including, for example, a handheld device of yours, payments made since your last connection to the PayFree server may be lost, and we disclaim all liability for any such losses.

LIMITED LIABILITY

PayFree Service is limited to providing members with a payment facility and does not ensure the quality, safety or legality of the transaction a member is undertaking. PayFree does not have any responsibility for any goods or services for which a member pays using PayFree and will not be liable for any charges, taxes or other duties in relation to such goods or services.

ERROR RESOLUTION PROCEDURES

In the event you notify us via telephone of a suspected error, we may require you to confirm the error in writing within ten (10) business days after your verbal submission. It is your responsibility to confirm that we have received your written complaint within the required time period. Your failure to timely send your written confirmation, and/or initially notify us, of the suspected error will result in the loss of your claim. If you choose, we can send you, upon request, your history in writing. We must hear from you no later than ten (10) days after the transaction in question has occurred. When contacting us please provide:

        1. Your name and PAYFREE e-Wallet account number.

        2. Date and amount of the transaction.

        3. Type of transaction and description of the error. Explain as clearly as possible why you believe it is an error and why you need more information.

        4. Amount of the suspected error.

        5. The location and time that the transaction took place

Within ten (10) business days after the receipt of your notification, your claim will be investigated. Our decision to credit your account for the disputed amount as a result of our preliminary determination does not necessarily entitle you to the funds, as a final determination may not be reached until forty-five (45) days after the receipt of your dispute. Within the forty-five (45) day investigation period, we will either (1) allow the credit for the disputed amount to remain on your account; (2) credit your account for the disputed amount, if not already credited; or (3) deny your claim and, if applicable, we will deduct the amount previously applied to your account. In the event we deny your claim, upon request we will provide you with a written explanation of our final determination.

SERVICE CHARGES

The unused funds left on the PAYFREE e-Wallet will be reduced by the amount of the current service charges for the services that are arranged through the use of the PAYFREE e-Wallet. In any event, you agree to pay to all relevant service charges (including all transactions imposed by others in connection with the use of PAYFREE e-Wallet). Please see the service charge disclosure for current service charges.

REDEMPTION OF UNUSEDS FUNDS

You will have 18 months from the date you close your account to request a refund of unused funds. To obtain your refund, contact us on our web site www.PayFree.com.ph. Upon receipt of your written request, we will refund any unused funds remaining in your account within 30 days.

DISCONTINUANCE OF SERVICE

If for any reason we cease to provide PAYFREE e-Wallet services and as a result the PAYFREE e-Wallet is deactivated while the member still has a positive balance on the account, then we will either (a) arrange for a deposit to the member’s bank account or (b) advance a cash (or check) payment to the member for the remaining balance on the account.

NON-INSURED

Member acknowledges that this account is not a PDIC insured account. These are not bank held accounts. You acknowledge and agree your balance is not a deposit, does not bear interest and is not insured by any government agency. You acknowledge and agree that you may only transfer or redeem the value of your balance in accordance with the terms and procedures described in this Agreement and on line at www.PayFree.com.ph.

AMENDMENT TO AGREEMENT

We may change the provisions of this Agreement and the service charges from time to time. We will notify you of any changes by posting a notice online at www.PayFree.com.ph. If we posted a notice, it is considered to be received/reveiwed by you 5 days after it is posted online. If you use the PAYFREE e-Wallet after we post a notice, you are deemed to have accepted the change as of the effective date set out in the notice.
